Power of attorney is the appointment of a substitute decision maker to make financial decisions for us—when we either cannot, or chose not, to make these decisions ourselves.

There is no law that states we must appoint an attorney. However, there are laws that dictate what will happen if we lose mental capacity and have not already exercised our right to appoint a substitute decision maker.
