Axl Rose sues Guitar Hero, crushes lotto winner's hopes

Guns ‘N’ Roses frontman Axl Rose’s lawsuit against video gaming publisher, Activision will proceed to court.

As reported by Spin, Rose first sued the company way back in 2010, claiming fraud and a breach of contract, alleging that Guns ‘N’ Roses songs and imagery were misused in Guitar Hero games and marketing.

Yesterday, Rose’s fraud claims were dismissed, however the Los Angeles judge has decided that the breach of contract suit had some strength and will move to trial in February 2013. “Activision had been intentionally concealing its plans to use Velvet Revolver and Slash in the game all along,” said Rose’s attorney, Skip Miller. Unfortunately for Rose, he waited too long to file the suit, under the guise of a “separate video game and other business proposals worth millions of dollars,” and the statute of limitations has run out.

According to Activision, although negotiations had been made with GNR Music, “Rose had no authority to enter into a license forWelcome to the Jungle in his individual capacity because he does not own the song of the sound recording.”

While Rose’s court squabbles continue, true GN’R fans refuse to give up hope of a reunion. One fan in particular, Adrian Bayford, who recently won $232 million in a UK lottery has said that he would like to use some of his winnings to convince Rose and Slash to reunite.

Sadly for Mr. Bayford, it seems money can’t buy love, at least not in this case, “I don’t think it’s a matter of money; it really isn’t,” Slash told CNN, “I think you’ve got a situation where no body involved wants to revisit.”
