This course examines the framework in Australia for the making of laws. It is a complex subject which spans many issues and topics. The dot points above set out the topics to be covered.
By far the largest section of the program is the last dot point. Interactions between statute law and case law take many forms. Some legislation deals with public rights. For example the Native Title Act 1993, as a result of a series of High Court decisions puts the Mabo case in the background and makes all of the case law about interpreting the Act. some legislation interferes with private rights. The Civil Liability Act, for instance, affects the operation of the law of and liability for negligence. The Australian Consumer Law alters contractual situations and implies terms into contracts, or ensures that some contracts do not permit certain things.
The purpose here is to enable you to understand what is going on in our Parliament and our court rooms around the country, how to navigate a legal question and ask the right questions so you can get the best from your lawyers if you have to get advice on a business, commercial or personal issue.
